  1. FINDERS FEE:The Buyer acknowledges that the Brokerage may be receiving a finder’s fee, reward and/or referral incentive, and the Buyer consents to any such benefit being received and retained by the Brokerage in addition to the commission as described above.

Finder’s Fee의 가장 대표적인 예는 모기지 브로커나 대출은행이 손님을 소개해 준 대가로 중개인들에게 주는 어떤 수익들 입니다. 이것은 금전적인 수익이 될 수도 있으며 또는 적립형 Point 일 수도 있습니다. 위 항목은 이러한 거래 수수료 외에 중개인들이 Finder’s Fee 명목으로 어떤 다른 수익을 받을 수도 있음을 Buyer가 인지하고 동의해 준다는 내용을 담고 있습니다.  물론 모든 모기지 브로커나 금융기관이 이러한 Incentive를 중개인들에 제공하는 것이 아님으로 이 ‘매입자 대리인 계약서’에 서명 할 당시 이러한 부분을 손님들에게 자세히 설명하는 중개인들은 거의 없습니다.

 

  1. CONSUMER REPORTS: The Buyer is hereby notified that a Consumer Report containing credit and/or personal information may be referred to in connection with this Agreement and any subsequent transaction.

보통 개인의 Credit이나 신상정보를 담고 있는 Consumer Report는 주택 거래 시 중개인들에게 필요한 경우는 거의 없습니다. 보통은 모기지를 신청할 때 금융기관에서 필요로 하는 것입니다. 하지만 부동산을 임대할 경우는 Landlord가 Tenant의 Consumer Report를 신청하는 경우가 있을 수 있습니다. 어떤 경우든 개인의Consumer Report를 신청할 때는 그 본인의 동의를 반드시 얻어야 함으로 이 계약서에 Buyer의 Consumer Report가 필요하게 될 수도 있음을 Buyer에게 미리 알려주고 동의를 얻는 것입니다.

  1. USE AND DISTRIBUTION OF INFORMATION:The Buyer consents to the collection, use and disclosure of personal information by the Brokerage for such purposes that relate to the real estate services provided by the Brokerage to the Buyer including, but not limited to: locating, assessing and qualifying properties for the Buyer; advertising on behalf of the Buyer; providing information as needed to third parties retained by the Buyer to assist in a transaction (e.g. financial institutions, building inspectors, etc…); and such other use of the Buyer’s information as is consistent with the services

provided by the Brokerage in connection with the purchase or prospective purchase of the property. The Buyer agrees that the sale and related information regarding any property purchased by the Buyer through the Brokerage may be retained and disclosed by the Brokerage and/or real estate board(s) (if the property is an MLS® Listing) for reporting, appraisal and statistical purposes and for such other use of the information as the Brokerage and/or board deems appropriate in connection with the listing, marketing and selling of real estate, including conducting comparative market analyses.

Buyer는 중개인과 중개인 회사가 부동산 거래를 목적으로 제공되는 모든 서비스 활동을 목적으로 Buyer의개인 신상 정보를 수집, 사용, 공개하는데 동의해 줍니다. 이러한 서비스는 여러가지를 포괄하고 있는데, Buyer가 원하는 부동산의 위치확인, 감정 평가 등을 포함하며, Buyer를 대신한 광고 활동, 모기지 브로커나Home Inspector에게 Buyer의 개인 정보를 제공해 주는 일 과 같이 부동산 매입에 관련된 Buyer의 개인 정보의 사용에 관한 것들을 포함하고 있습니다.

Buyer가 이 중개인을 통해 매입 하게된 부동산의 판매정보가 중개인 회사나 부동산 협회가 차후 부동산의가치 평가나, 보고서 작성, 통계 집계의 목적으로 공개 될 수 있도록 동의해 줍니다. 이러한 정보는 향후 다른 부동산의 Listing이나 감정평가 그리고 시장비교분석 과 같은 Marketing 목적으로 사용됩니다.
